General provisions

1. All subscriptions taken out with Eurobias or renewed infer full acceptance on the part of the subscriber of all the present general conditions of sale. The present general conditions of sale and the terms of use of the Eurobias web site prevail over all other conditions notably any conditions of purchase afforded the subscriber. Only the specific terms or conditions of a special contract concluded between Eurobias and the subscriber may prevail over the present general conditions of sale.

2. Any dispute regarding the validity, interpretation or execution of the contract will be referred before the appropriate court in Brussels, including summary procedures and cases involving more than one defendant. Only Belgian law is applicable. These general provisions are written in French and English. The text in French is the authentic text.

Limitation of liability

3. As a business support service specialising in monitoring European affairs, Eurobias strives to provide relevant, accurate and up-to-date information. However, Eurobias declines all responsibility in case of injury to the subscriber or any other corporate body or individual stemming from the exploitation of erroneous information or the absence of an item of information. In any event liability will never exceed the amount paid to us for the service.

4. Eurobias updates its Web site on a regularly basis and reserves the right to defer publication of any item of information if forced to do so by circumstances or technical problems.

5. Should Eurobias interrupt one of its services, its liability is limited to replacing the service which has been interrupted by an alternative service providing similar information. The subscriber nevertheless remains free to cancel his subscription. In this eventuality, Eurobias will reimburse the subscriber for the not received service between the break of the service and the expiry of the subscription.

Subscriptions, tariffs, payment

6. Subscription periods are specified on invoices and run in principle for 12 months.

7. Subscriptions always begin on the first day of a given month.

8. All subscriptions may be cancelled in writing by registered items (emails and faxes are not accepted) at the latest a month before expiry. No refunds are available in cases of cancellation of ongoing subscriptions.

9. All subscriptions not cancelled a month prior to their expiring will be automatically extended.

10. Unless mentioned otherwise, all our prices are indicated in Euros (€).

11. Eurobias invoices are payable in full and net of transaction fees, which remain charged to the subscriber. The subscriber alone is responsible for effective payment, with payment deemed to have been made only once Eurobias accounts are credited with the sum due. If payment is delayed, subscription will be suspended without prior notice. It will be resumed again upon receipt of the total amount.

12. After a first reminder, non-payment of invoices on time will leave the subscriber liable without prior notice to late payment costs equal to 15% of the sum due as compensation with a minimum of 123,95 € and an interest on arrears of 1% by month starting from the date the sum is due.

Protection of privacy

13. Information concerning subscribers is held on Eurobias files in accordance with legislation. Subscribers can request access to this information at any time and demand that any inaccuracies be corrected. This information will under no circumstances be passed on to third parties, except in the context of the subcontracting of services.

14. Eurobias reserves the right to contact the subscriber in order to provide all appropriate information regarding the services offered by Eurobias which could interest the subscriber. The subscriber can nevertheless at any time request that the dispatch of such messages cease; the subscriber’s request will then be met at the earliest opportunity.

Copyright

15. All information published by Eurobias as well as the content and design of the Eurobias web site are protected by Belgian copyright law and intellectual rights and regulations. Reproduction of part or all of the contents in any form of the Eurobias Web site is prohibited unless written authorization has been obtained beforehand. Users may, however, copy and print the output of their specific searches on regulatory information for internal purposes provided the source is acknowledged and provided no existing copyright or other proprietary notice is deleted by the user.

16. Each Eurobias’s protected area is strictly personal and can only be used by the subscriber. The latter is not authorised to disclose his access codes for any reason. In cases on non-compliance, Eurobias reserves the right to close the subscriber’s protected area without warning and without compensation for the user.

17. In cases of plagiarism or violation of copyright, fault is in no way diminished by sincerity or references to sources.

18. All violations of copyright and plagiarism (notably under the terms of the present general conditions of sale) will inevitably result in a flat-rate fine of 1200 €. An additional penalty of 100 € per violation will also be charged. The total penalty will be the object of a bill payable in full and net of transaction fees, which remain charged to the debtor.
